Hi Pam, 

As PSHA's VP for Governmental Relations I am working to get the licensure act 
rewritten.  In fact, David Tive, the lobbyist, and I are going before the State 
Board of Speech-Language and Hearing Examiners in February to apprise them of 
changes we are proposing in the redraft.  I am looking for advocates to get 
state representatives and senators on board when we reintroduce the bill in the 
house and senate.  Also, if you have ENTS/ORLs who support our passing the scope 
who are willing to write letters of endorsement, that would really help.  
Although what you said is not incorrect, I just want to caution others that the 
only way a licensee can find out if he/she is allowed to perform a certain 
function is to do it. If it is challenged, and he/she is brought up before the 
board on charges, then the board can make a determination of whether it is 
allowed or not.

In the last couple of years, the legal team, in conjunction with the 
laryngologists, at the Hospital of the University of Pennsylvania concluded that 
nasendoscopy was viewed as a tool.  In the hands of a laryngologist, the use of 
this tool resulted in a medical diagnosis. However, in the hands of an SLP, the 
use of the same tool resulted in a functional diagnosis.  They concluded that a 
nasendoscopy trained SLP is not in violation of the licensure act as long as the 
SLP continues to provide functional diagnosis of speech, voice and/or swallowing 
disorders. Our lobbyist indicated that their 
interpretation has no legal effect whatsoever and that anyone who moves forward 
on doing nasendoscopy, based on the opinion from Penn, could still be subject to 
sanction from the board. On the other hand, if someone is willing to take a risk 
and be a "test case,? that could give the board the opportunity to say that it 
is allowable to do a nasendoscopy. 

Believe me, I am working to get this changed so we can perform instrumental 
procedures.  It seems so unfair that those excluded from the licensure title 
act, e.g., VA SLPs, can pass the scope, perform VFSS with just a radio tech, and 
even prescribe therapy.  I would love the help and was going to be contacting 
your committee in January to see if we could rally forces.  Glad we are getting 
the discussion out there.
